Why is it important to have a will?

Having a will allows you to officially decide:
- What happens to your home
- How all of your other assets are divided, and who they go to
- Who looks after your children if they’re under 18
It’s especially important to have an up-to-date will if:
- You own a home. This is so you can specify what you want to happen to it after you’re gone, including who should inherit it.
- You’re a parent or legal guardian of a child under the age of 18 (your will is the document that allows you to have a say in who you’d want to look after them if you and your partner/co-parent were no longer around).
- You’re in a relationship, but aren’t in a civil partnership or married. In this case, your partner wouldn’t have any automatic rights to your estate if something were to happen to you – so your will is the place where you can specify what you want them to inherit, and where you can lay out a plan to make life easier for them.
- You’re separated or divorced. If you’re separated but not divorced, your ex-spouse could still inherit your estate if something were to happen to you. This may suit some people, but not all. Writing a will gives you control over where your assets go, and who can inherit them. If you’re divorced, any previous will you had needs to be reviewed.
- If you’re divorced any previous will you had will need to be reviewed.
- You own a business. This is so you can make sure the people you want will take on the responsibility for your business after you’re gone.
- You want to make the lives of the people you leave behind easier.
No matter what assets you have or your situation, having a will helps save the people you love time, money, and stress. Writing a will is a gift you can give the people you love to make their lives easier when it matters the most.
What happens if you die without a will?
Dying without having a will is called ‘dying intestate’ and it means that the law determines where your assets, including your home, end up and who is responsible for your children.
One size doesn’t always fit all – and this doesn’t suit everyone. Most people want to have a say in what happens to the people and things they care about after they’re gone.
Plus, dying without a will costs £1000s for the people left behind, and it means more paperwork, hours of admin and stress for them too, all when they need it the least.
What things should I consider before writing my will?

- If you’re a parent of children under the age of 18, if the worst were to happen, who would you want to look after them?
- If you have pets, if the worst were to happen, who would you want to look after them?
- Who do you want to be in charge of carrying out the wishes you lay out in your will (your executors)?
- Do you want to leave a gift in your will to charity? If so, to which charity/charities?
- Do you have any sentimental gifts you want to leave to the people you love?

- Follow the simple step-by-step process: tell Octopus Legacy what you have and what you want to happen to it. Share your wishes and plans to make life easier for the people you leave behind.
- Consider including a gift in your will to the charity as a thank you: although this isn’t required to claim your free will offer.
- Octopus Legacy’s legal experts will review everything: to make sure your will is legally sound and your wishes will be reflected after you’re gone.
